Translation of code telegram of 20th August from Secretary
of State to H. E. the Governor.

August 20th. My despatch 30th April, 1910, Circular, His Majesty's Government are advised that as regards German merchant ships in British Ports at outbreak of war or entering in ignorance of hostilities, His Majesty's Government are bound under Articles two and four in 1st paragraph and 5 of Hague Convention No.6 of October 18th 1907 regarding status of enemy Articles 3 and 4, 2nd paragraph as to which Germany made reserves. His Majesty's Government are advised that there is no contradiction between Article 9 Orders in Council August 4th regarding detention merchant ships and the convention, as, though ships are liable to capture and adjudication, the adjudication need not be followed by condemnation Bee prize rules Order 28 Rule 1. This has been explained to United States and should be brought to notice of Prize Courts. At the same time it might be well to inform Prize Courts that at midnight August 7th the Secretary of State for Foreign Affairs formally notified Lords Commissioners of Admiralty that Arti- cles 3 to 8 of Orders in Council will not come into operation
as regards Germany.
